Terms of Service

These Terms of Service (“Terms”) govern your use of our VPN, DNS, and related services. By accessing or using our services, you agree to be bound by these Terms.

1. Services Overview

nCheck provides VPN services using secure tunneling protocols and DNS filtering/resolution services designed to enhance privacy and network control.

2. Eligibility

You must be at least 18 years old or have legal parental/guardian consent to use our services and be legally permitted to do so in your jurisdiction.

3. Account Registration

To access certain services, you may be required to provide an email address or device identifier. You agree to provide accurate information and maintain credential confidentiality.

4. No-Logs Policy

We operate a strict no-logs policy. We do NOT collect, store, or retain: IP addresses, browsing activity, DNS queries linked to individuals, connection timestamps, or bandwidth usage. Our systems operate in a stateless manner where possible.

5. Service Infrastructure

Our services are hosted using third-party infrastructure providers in South Africa, including Webway and HostAfrica. Infrastructure is currently located in Cape Town and Johannesburg.

6. Acceptable Use Policy

You agree not to use our services for illegal activities, malware distribution, phishing, network attacks (DDoS), spam, or attempts to exploit our services. We reserve the right to suspend access for violations.

7. Service Availability

While we aim for continuous service, we do not guarantee 100% uptime. Service interruptions may occur due to maintenance, upgrades, or external provider issues.

8. Third-Party Services

We rely on third-party providers for operational functions (e.g., SMTP via Domains.co.za and hosting). We are not responsible for the policies or actions of these third-party providers.

10. Limitation of Liability

To the maximum extent permitted by law, nCheck is not liable for indirect, incidental, or consequential damages. Our total liability is limited to the amount paid for services.

11. POPIA Compliance

We comply with the Protection of Personal Information Act (POPIA). Users have the right to access, correct, or request deletion of their personal data.
